SUBJECT:   FACILITIES EFFECTIVE:  September 16, 2004
Section:   918 Alcoholic Beverages
  1. Definitions.

    1. "Alcoholic beverages" means any liquid suitable for drinking by human beings, except prescription drugs or over-the-counter medications, which contains one-half of one percent or more of alcohol by volume.

    2. "Controlled substance" means any drug, substance or immediate precursor listed in 21 U.S.C. Section 812.

  2. Possession, sale, dispensation, use or consumption of alcoholic beverages upon land or in buildings owned by the Board or its institutions is prohibited, except as provided by this subsection.

    1. This policy does not apply to homes furnished to institution officials, family housing, married student housing, faculty housing or off-campus guest housing.

    2. Alcoholic beverages may be permitted, subject to applicable state and local laws and ordinances, at events in facilities or upon land owned by the institution pursuant to a permit signed by the institution's chief executive or designee. The permit must describe the nature of the event and the date(s), time(s) and place where consumption of alcoholic beverages is permitted. The permit may be for a single event or for events occurring periodically at the designated place during a period of not more than one year.

    3. Sale and service of alcoholic beverages for consumption on premises may be permitted in the Ralph Engelstad Arena/Betty Engelstad Sioux Center at UND and in restaurants, meeting rooms and guest rooms in commercial hotels or motels or in other restaurants located on leased land developed under Policy 910.1. Restaurants must be full service establishments where service of meals is the primary focus. Night clubs and bars where full meal service is not the primary focus are not permitted. This authority is subject to relevant state and local laws and such additional restrictions as may be imposed by the Board in authorizing the development or in lease agreements entered into by the institutions.

  3. Alcoholic beverages may not be purchased with public funds.

  4. Employees of the Board or its institutions shall not come to work or be at work, during normal work hours or other times when required to be at work, while under the influence of alcoholic beverages or as a result of the unlawful use of a controlled substance.

  5. Any employee violating this policy is subject to discipline up to and including termination.
